These Terms of Service ("Terms") govern your access to and use of the apexlaunch construction project performance analytics platform and related services ("Services") provided by apexlaunch B.V. ("apexlaunch", "we", "us", or "our"), a company registered in the Netherlands with registration number KvK64258973.
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services. These Terms apply to all users of our Services, including browsers, customers, and other users who access or use our platform.
apexlaunch provides a comprehensive construction project performance analytics platform that enables construction professionals to monitor, analyse, and optimise their project outcomes. Our Services include real-time project monitoring, predictive analytics, custom dashboard creation, data integration capabilities, and related consulting services.
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with reasonable notice to users. We may also impose limits on certain features or restrict access to parts of our Services without notice or liability.
To access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorised use of your account or any other breach of security. We will not be liable for any losses caused by unauthorised use of your account, but you may be liable for losses incurred by us or others due to such unauthorised use.

Our Services and all materials included therein, including but not limited to software, text, graphics, logos, icons, images, audio clips, and data compilations, are the property of apexlaunch or its licensors and are protected by copyright, trademark, and other intellectual property laws. The apexlaunch name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of apexlaunch or its affiliates.
You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from our Services, except as permitted by these Terms or with our prior written consent.
Certain features of our Services may require payment of fees. All fees are quoted in Euros and are exclusive of applicable taxes unless otherwise stated. Payment terms will be specified in your service agreement or subscription plan. You agree to pay all applicable fees and charges in accordance with the payment terms.
We reserve the right to change our fees and payment terms at any time with reasonable advance notice. Continued use of our Services after such changes constitutes acceptance of the new fees and terms.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.
To the maximum extent permitted by applicable law, apexlaunch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our Services.
Our total liability to you for all damages, losses, and causes of action arising out of or relating to these Terms or your use of our Services shall not exceed the amount paid by you to apexlaunch in the twelve months preceding the event giving rise to the liability.
Our Services are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of our Services or the information, content, materials, or products included therein. To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
You agree to defend, indemnify, and hold harmless apexlaunch, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of our Services.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Amsterdam, Netherlands, and you hereby consent to personal jurisdiction and venue therein.
If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable consumer protection laws.
We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our Services will cease immediately, and we may delete your account and all related information and files.
You may terminate your account at any time by contacting us or following the account closure process in our platform. Termination of your account does not relieve you of any obligations incurred prior to termination.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired thereby.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our Services after such modifications constitutes acceptance of the updated Terms.
